1. Agreement

These Terms & Conditions ("Terms") form a legal agreement between you and the developer of Spendwise ("we", "us", "our") covering your use of the Spendwise application and this website. If you do not agree with them, please do not use the app.

You must be old enough to enter into a binding agreement in your country of residence to use Spendwise.

2. What Spendwise is — and is not

Spendwise is a personal record-keeping tool. It helps you write down and review your own income, expenses, budgets, and informal loans with people you know.

3. Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Spendwise on devices you own or control, for your own personal, non-commercial purposes. This licence is subject to these Terms and to the rules of the app store you downloaded it from.

You may not copy, sell, rent, sublicense, reverse-engineer, decompile, or attempt to extract the source code of the app, except where such restriction is prohibited by applicable law. You may not remove or alter any copyright, trademark, or attribution notices.

The Spendwise name, logo, and app icon remain our property. These Terms do not grant you any rights to them.

4. Your data and your responsibility

Your records are stored on your device, as described in the Privacy Policy. We do not hold a copy, which has an important consequence:

• If you lose your device, uninstall the app, or clear its data, your records are gone. We cannot recover them for you.
• Keep your own backups. Use Settings → Backup & Restore to save a backup file somewhere safe, and refresh it from time to time.
• Backup files are not encrypted. Store them somewhere you trust, and be careful about sharing them.
• You are responsible for making sure the information you record is accurate, and for keeping your device and its screen lock secure.

5. Acceptable use

You agree not to:

• use the app for anything unlawful or fraudulent;
• use it to harass, track, or store personal information about another person without their consent;
• attempt to interfere with, disrupt, overload, or gain unauthorised access to the app or any service it relies on;
• use automated means to access or extract data from the app; or
• use the app in any way that infringes the rights of others.

6. Availability and updates

Spendwise is designed to work offline, but we do not guarantee that it will always be available, error-free, or compatible with every device or operating system version. We may release updates that change, add, or remove features, and we may discontinue the app at any time. We recommend installing updates when they are offered, as older versions may stop being supported.

7. Third-party services

The app is distributed through Google Play, and uses Expo's EAS Observe service for anonymous crash and performance diagnostics (see the Privacy Policy). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the practices or availability of third-party services.

8. Disclaimer of warranties

Spendwise is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the app will be uninterrupted, timely, secure, or free of errors, or that any defect will be corrected.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Nothing in these Terms limits any rights you have that cannot be excluded by law.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or goodwill, arising out of or related to your use of, or inability to use, Spendwise — including loss of records resulting from device failure, loss, uninstallation, or failure to keep a backup.

Where liability cannot be excluded, our total aggregate liability to you is limited to the greater of the amount you paid for the app or one US dollar (USD 1.00).

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded.

10. Termination

You may stop using Spendwise at any time by uninstalling it. We may suspend or terminate your licence if you materially breach these Terms. On termination, the provisions that by their nature should survive — including sections 4, 8, 9, and 11 — will continue to apply. Since your data lives on your device, uninstalling the app also deletes it; we hold no copy to return or erase.

11. Governing law

These Terms are governed by the laws of India, without regard to its conflict-of-law rules. You and we agree to submit to the exclusive jurisdiction of the courts of India, except that either party may seek relief in any court of competent jurisdiction to protect its intellectual property rights.

Nothing in this section removes any protection you are entitled to under the mandatory consumer-protection laws of your country of residence.

12. Changes to these terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page and publish the new version here. Continuing to use the app after a change means you accept the updated Terms.
